Mojang's new rule against profit from Minecraft- Is it fair?

Doesn't the EULA only cover profits from sales covering items that help you in the real game of Minecraft, such as diamonds, iron, tools of the sort....

I thought that perks such as MCGamer does here, that in no way help you in the game, are fine?

Let me clear this up...

The EULA already states that people cannot make money from Minecraft, so any server who sells packages/kits for money is technically breaking the law. Fortunately, Mojang hasn't enforced this rule stated in their EULA. They now want to enforce it because there were servers who sold $1,000 kits and people were actually buying them. As of this time, the discussion is in serious deliberation and no decision has been made. In fact, all this trouble started from a small Skype message. Here is a video describing these changes:

Not sure about this, but Donor privileges for, say joining servers (kicking lower ranked players) wont stop exisitng. If this is true, then they problem shouldnt be that big.

Implying I didn't read them myself, I put the video up there for people to understand everything clearly, the youtubers themselves simply read off the rules in a easy to understand way for the *ahem* lessers of the website here.

In my opinion the change is quite nice. They said "Everyone needs to donate to play and gets perks, or no one does" although it sounds quite socialist, it's the kind that works out well. It removes dumb servers where only the guy with the big wallet gets to have fun. IE: RPG servers.
If the implemented this in Gmod servers I wouldn't complain at all.
Yes but, just for example, here on MCSG donors do not receive anything at all that makes them better or gives them an ingame advantage. I mean, we can kick people to play more games, and we can wear fancy clothes and talk in colorful chat styles, but we don't get kits or things that give us ingame boosts. Also the majority of servers I know about are just as fair as this. It all comes back to the point of one small unfair group seems to ruin it for everyone else who follows the rules.

According to the post by mojang even flying could be Illegal.

"We don’t mind you selling items in game, but they must be purely cosmetic. Pets, hats, and particle effects are OK, but swords, invincibility potions, and man-eating pigs are not. We want all players to be presented with the same gameplay features, whether they decide to pay or not."

Well flying in the hub and lobby. For $100 platinum donors should get something like that.

But you can't fly ingame, where it would actually matter. Wouldn't just having it in the hub/lobby be purely cosmetic?
