With the amount of PvP texture pack edits and such featuring his textures, available for download, I don't think d3fin3d went and enforced the 'use textures only with my permission' rule.Under the rules of Defscape:
These unique works, Defscape 16x, Defscape 32x & Defscape 64x are protected by copyright. You do not have permission to remix, modify, rename, copy and/or distribute any of these packs or the content within these packs unless specifically granted permission by the author.
Have you request permission from the author, I don't think so. If you have proof, put it in the thread.
Under the rules of Sphax:
It is against the License and explained in the FAQ that redistributing the textures from the main texture packs created by Sphax isn't allowed without permission.

If you have all the proof, then I'll leave.
Neither does Sphax- it seems a little bit stupid to open a lawsuit on some innocent person who accidentally used a virtual collection of pixels (a texture) without getting permission to do so.
I don't think anybody has gotten into serious trouble over using copyrighted textures.
