When can we expect the issue where the menu that would usually be at the top of a thread is gone to be fixed?

Clarification: The menu I'm talking about is the one where you change the color, font size, etc.

There is no issue; the new editor (which is a lot more stable too, thanks XenForo team!) simply has buttons moved around a bit.
Just click on each of the icons to familiarize yourself with what they do. There's definitely a font color and size icon there.

On the flexile dark theme, which a majority of users, use, it isn't. On flexile dark nearly everything is screwed up.

Yeah... according to @subv3rsion, that theme is old and was never properly updated, so there's a lot that has to be done on it. For now, use the lighter "Minecraft Survival Games" theme.

I'd recommend making a front page post about that because the majority of people use the flexile dark theme. Just a suggestion if you don't want people to become angry.
