I am pretty sure you can only get IOS7 with the newest ipod/iphone (ipod 5, Iphone 5, Iphone5C, Iphone 5S)

I, too, use an iPod Touch 4, and I neither have the notification nor the option to upgrade to IOS7 or w/e.
iOS 5/6 made my iPod way too laggy as it is, anyways, and 7 would just make it slooooow I think.
(I didn't check iTunes if I could upgrade, but I don't think I can)

Plug it into your computer. Open itunes. And check for updates. Mine showed up with one. But I didn't update it since I use my iPhone 4.

I got it on my ipad 2. Just go to software update, for some reason it doesn't show a notification.
